These Terms of Service ("Terms") govern your access to and use of the websites, applications and services provided by Blitzball Labs, a brand operated by Beijing Shandianqiu Entertainment Co., Ltd. (北京市闪电球娱乐有限公司) ("Blitzball Labs", "we", "us"), including the Blitz DAW and CloseCrab software, our website at blitzball.lol, and any paid licenses or accounts (together, the "Service"). By downloading, installing, accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
By using the Service you confirm that you are at least 16 years old (or the age of digital consent in your country) and able to enter into a binding agreement. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
Blitzball Labs builds native, local-first AI software for creators and engineers:
The core applications are free and open source under the MIT license. Optional Pro and Studio / Team tiers unlock advanced packs, commercial-use licensing and priority support. We may update, change or discontinue features at any time. Open-source components remain governed by their respective open-source licenses.
Some features require an account. You are responsible for keeping your credentials secure and for all activity under your account. You must provide accurate information and a valid email address. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
Paid tiers are delivered as a license serial key. Activation is online and bound on a one-key-one-device basis. Subject to your continued compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use the paid features on the number of devices/seats included in your tier.
You agree not to:
You are solely responsible for any content, audio, code or other materials you create with the Service.
Prices are shown on our Pricing page. Payments are processed by third-party payment providers (for example Airwallex), who handle your card and payment details — we never see or store your full card number. By purchasing, you authorize the applicable charge.
Refunds are governed by our Refund Policy.
The Service, brand, logos and closed-source paid components are owned by Blitzball Labs and protected by intellectual-property laws. Open-source components are licensed under their stated licenses (MIT for the core apps). You own the content you create with the Service — we claim no ownership of your projects, audio or code.
The Service may rely on or integrate third-party services (payment processing, optional AI model providers, fonts and infrastructure). Your use of those services may be subject to their own terms. We are not responsible for third-party services and do not control them.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that AI-generated output will be accurate or suitable for your purposes. You are responsible for backing up your work.
To the maximum extent permitted by law, Blitzball Labs shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, revenue or goodwill, arising from your use of the Service. Our total aggregate liability for any claim shall not exceed the amount you paid us for the Service in the twelve (12) months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.
You may stop using the Service at any time. We may suspend or terminate your access or licenses if you breach these Terms, engage in fraud or initiate an unjustified chargeback. On termination, your right to use paid components ends; sections that by their nature should survive (IP, disclaimers, liability, governing law) will survive.
These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules. Disputes will be submitted to the People's Court of Fengtai District, Beijing, the People's Republic of China, unless mandatory consumer-protection law in your country provides otherwise.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
